Official Rules for the 2020 Stand Together Family Recipe Contest (“Contest”)

Overview. By participating in this Contest, each participant (“Participant”) agrees to: (a) be bound by these Official Rules and by the final decision of Stand Together Chamber of Commerce, Inc. as sponsor (“Sponsor”), and (b) receive email newsletters and other communications from Sponsor. This Contest is subject to all applicable United States federal, state, and local laws. No purchase necessary. Void where prohibited.

Eligibility. The Contest is open to all persons physically residing in the fifty (50) United States and the District of Columbia who are 18 years of age or older at the time of Entry. Employees, contractors, agents, board members, and any other individuals compensated by Sponsor, PBS, a Platform, a Judge, or any of its/ their affiliates or subsidiaries (collectively, the “Released Parties”), and the immediate family members of those individuals, are not eligible to participate in this Contest.

Contest Period. The entry period (“Contest Period”) begins on October 13, 2020 at 9:00 AM ET and ends on November 4, 2020 at 5:00 PM ET.

How to Enter. To enter the Contest, you must submit an entry form through the www.explorecommonground.org/contest landing page during the Contest Period that includes:
• a creative recipe name (“Title”),
• a detailed recipe with ingredients, instructions, and number of servings (“Recipe”),
• an explanation of why the Recipe represents your family story and means something to you (“Story”), and
• certain contact/ other information, including a valid email address (collectively, the “Entry”).

Entry Restrictions. If any part of the entry form or Entry is not completed or is invalid, your submission may be excluded from the Contest. Non-winning Entries will not be carried over to any other contest or promotion. Each Participant may enter more than once with a different Recipe and Story for purposes of the Grand Prize (defined below) but only the first entry of each individual Participant will be considered in awarding a Book (defined below). Sponsor reserves the right to exclude any Entries it deems duplicative, incomplete, inappropriate, not consistent with the Judging Criteria, or otherwise in violation of these Official Rules. Entries submitted through automatic, programmed, or comparable methods will be void. Only entries submitted in English will be considered. Sponsor is not responsible for late, misdirected, corrupted, or garbled entries or for any other entry submission problems of any kind, technical or otherwise, including without limitation network connection or equipment issues or incomplete capture of Entry information, regardless of cause. Proof of submission will not be proof of receipt by Sponsor of a complete and timely Entry. If there is any dispute as to who submitted an Entry, the holder of the email account used in the Entry will be deemed the Participant. Entries shall contain only the original content of Participant. Entries shall not contain any content that violates or infringes upon the rights (including copyright, trademark, privacy, publicity, and other rights) of anyone, any content that is unlawful, or any content that promotes discrimination or that disparages or reflects negatively on Sponsor or any other party.

Judging Criteria. The Recipe, Story, and other portions of each Entry will be judged by a qualified panel of three to five judges selected by Sponsor who will judge the Entry based on the following criteria:

Story (75%)
Ingredient List and Preparation Instructions (15%)
If there is a tie, the highest score for Story will be the tiebreaker. Judging decisions of the Judges and Sponsor shall be final. Only Entries that comply with these Official Rules, and that feature content suitable for presentation in public, will be eligible. Sponsor reserves the right, in its sole discretion, to select fewer winners of any Prize if it does not receive enough eligible and qualified Entries, or to cancel, modify, or suspend the Contest at any time (or disqualify any number of Entries), if it suspects that any technical issue, fraud, or other event has corrupted or affected the administration, fairness, or proper conduct of the Contest.

Selection and Notification. On or about November 11, 2020, Sponsor will contact one or more potential winners that preliminarily are selected for Grand Prize eligibility based on compliance with these Official Rules and based on the Judging Criteria. The potential winner must sign an affidavit of eligibility and liability release (“Form”) to be deemed the actual winner of the Grand Prize. If a potential winner does not promptly respond to Sponsor’s confirmation email or call, does not return a signed copy of the Form (without change) to Sponsor in accordance with Sponsor’s instructions, does not cooperate with Sponsor to schedule redemption of the Prize, or if Sponsor determines that awarding the Grand Prize to such potential winner might reflect negatively on or endanger Sponsor or any Released Party, in each case in Sponsor’s sole discretion, then that potential winner may be disqualified and another potential winner may be chosen to receive the Grand Prize. Sponsor has no obligation to disclose to a potential winner why disqualification occurred. Odds of winning the Grand Prize depend on the number and quality of eligible Entries received. Participants who submit the first 100 complete, timely, and otherwise eligible Entries will receive a free copy of Pati Jinich’s cookbook, Pati’s Mexican Table (“Book”) (max one per Participant), via U.S. mail or other shipping method selected by Sponsor.

Prize(s). One Contest winner will receive the opportunity to participate in an Instagram Live (or other distribution method selected by Sponsor) cooking session with Pati Jinich on a date selected by Sponsor, currently anticipated to be November 13, 2020, to discuss and present the winner’s Recipe and Story, in which the winner will participate live via video from the winner’s home or other location selected by Sponsor and Pati Jinich will participate from her home or other location selected by Sponsor (collectively, the “Grand Prize”). To redeem the Grand Prize, the winning Participant shall comply with all requirements of Sponsor and other parties necessary to prepare, produce, and distribute the Grand Prize experience via video from the Participant’s home or other location designated by Sponsor, which may include providing a film crew with access to Participant’s home and permitting the rearranging of surroundings for the video capture. The approximate retail value (“ARV”) of the Grand Prize is $0 and the ARV of each Book is $30. It is the sole responsibility of the winning Participant to pay all federal, state, and local taxes applicable to the Prize, and to pay all other costs and expenses associated with Entry or with a Prize (such as transportation or ingredient costs). No Prize is transferable, sellable, or redeemable for cash, unless required by law. If any or all of a Prize is unavailable or impracticable, Sponsor reserves the right to substitute a Prize of equal or greater value. “Prize” means the Grand Prize or Book.

Release. Participation in the Contest and/or acceptance of a Prize constitutes a Participant’s consent for Sponsor and/or a Released Party to use Participant’s name, city, state, Entry (in part or in whole, edited or original), likeness, photograph, picture, portrait, voice, biographical information, and words (including, without limitation, as shared during redemption of the Grand Prize and associated content capture), in their original form or edited, for advertising, promotional, and other purposes, in any media now known or hereafter developed, without notice to, consent from, or additional compensation payable to Participant, except where prohibited by law. By participating in this Contest (including without limitation through a partial or complete Entry), each Participant agrees to release and hold harmless Sponsor, the Released Parties, and its/ their advertising and promotion agencies and each of their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with the Contest, or acceptance and/or use or misuse of a Prize, or for any claims based on publicity rights, defamation, invasion of privacy or otherwise. The Entry (including, without limitation, the Recipe and Story), photographs, video submissions, negatives, other images, voice recordings and/or other likenesses submitted under this Contest or captured as part of the redemption of any Prize or otherwise shall be owned exclusively by Sponsor.

Limitation of Liability; Governing Law and Venue; Waiver of Jury Trial; Errors. In no event shall Sponsor or any Released Party be liable to Participant for special, indirect, incidental, or consequential damages, including without limitation, lost profits, regardless of whether such damages are caused or allegedly caused by breach of contract, tort or otherwise (including without limitation due to a negligent or willful act or omission, warranty, indemnity, or strict liability). The Contest and these Official Rules shall be governed by the laws of the Commonwealth of Virginia without regard for its conflict of laws doctrine, and regardless of where Participant lives or submits an Entry. Participant agrees that any legal action arising in connection with the Contest, whether in tort, contract, or otherwise, shall be heard exclusively in the courts of the Commonwealth of Virginia. As a condition of participating in this Contest, each Participant hereby irrevocably and perpetually waives any right that Participant may have to a trial by jury in respect of any litigation directly or indirectly arising out of, under, or in connection with the Contest, including without limitation the Form or any document or agreement entered into in connection with the Contest, and any Prize. Sponsor also is not responsible for any printing, typographical, mechanical, technological, human or other errors in these Official Rules, in the administration of the Contest, in the announcement of a Prize winner, and/or in any advertising or other associated promotional materials in connection with the Contest.

Winner Identification. Requests for a list of Prize winner(s) should be directed to Stand Together Chamber of Commerce, Inc., ATTN: Legal Department, 2300 Wilson Blvd., Suite 500, Arlington, VA 22201, within thirty days of the end of the Contest Period.

Sponsor. The Sponsor of the Contest is Stand Together Chamber of Commerce, Inc., 2300 Wilson Blvd., Suite 500, Arlington, VA 22201. This Contest is not sponsored, endorsed, or administered by, or associated with, PBS, Instagram, Facebook, and any other social media platform used to host or promote the Contest (“Platforms”).
